The sale of a property prior to trial in a partial summary judgment considered

Five day trial on parenting time, decision-making responsibility, spousal support, and child support

The court stayed enforcement of an outdated support order after finding that only the childāsupport issue met the threshold for urgency during COVIDā19ārestricted operations

Motion for extension of limitation period under under
s. 2(8) of the Family Law Act

Uncontested Trial resulting in overpayment of child support, a declaration the child is no longer a "child" under the Divorce Act, a reimbursement of overpaid child support, and a costs order

The court held that the children living in a shelter was an unanticipated material change adversely affecting their best interests and ordered that the children temporarily reside with the father until the mother secures stable housing

The court reviewed the legal framework for costs in family law and concluded that although the Wife was the successful party and the motion was necessary to advance the matter, there was no evidence of bad faith or unreasonable conduct by the Husband warranting elevated or full indemnity costs. Accordingly, the Wife was awarded reduced, partial-indemnity costs for the motion, reflecting reasonableness and proportionality
